第五条 
市人民政府统筹指导太行古堡群的保护管理工作。

县（市、区）人民政府负责本行政区域内古堡的保护和监督管理工作。

市、县（市、区）人民政府相关部门和乡（镇）人民政府应当按照各自职责做好本地古堡的保护管理工作。

第二章  规划与管理

exactly\">第九条  市人民政府应当组织编制太行古堡群保护总体规划。县（市、区）人民政府组织相关职能部门制定古堡群保护专项规划，并报市人民政府批准后实施。

exactly\">古堡开发利用相关建设工程应当按照太行古堡群专项规划进行。属于文物保护单位的古堡，确因需要建设的项目，工程设计方案及文物保护建设方案须报相关部门批准。

县（市、区）人民政府应当对不符合太行古堡群保护规划的建筑物、构筑物责令限期清理、整改；对周边已遭到破坏的景观、植被等责令相关责任人及时修复。

第十一条
 市、县（市、区）人民政府应当完善古堡的公共基础设施和公共服务体系，鼓励具有开放条件的古堡依法对外开放。 仿宋;mso-bidi-font-family:仿宋;letter-spacing:.2pt\">

（一）保护范围内的古堡建筑物、构筑物、附属建筑物及遗址； 仿宋;mso-bidi-font-family:仿宋;letter-spacing:-.7pt\">

（三）古堡建筑保护管理机构保存、陈列的文物和重要资料； 仿宋;mso-bidi-font-family:仿宋;letter-spacing:-.5pt\">

exactly\"> 仿宋;mso-font-kerning:1.0pt\">第十六条 mso-bidi-font-family:仿宋;mso-font-kerning:1.0pt\"> 县（市、区）人民政府应当开展古堡的调查初审工作，并将审核通过名单向市文物行政主管部门进行申请认定。

exactly\">市文物行政主管部门收到认定申请后，应当组织相关部门、专业人员进行评审，并提出审查意见报市人民政府批准后向社会公布。

第十七条  市人民政府应当建立太行古堡群保护名录，制发统一的保护标志。列入保护名录的古堡，不得擅自改变名称。确需变更的，应当报市人民政府批准并重新公布。

exactly\"> 仿宋;mso-bidi-font-family:仿宋;mso-font-kerning:1.0pt\">市、县（市、区）文物行政主管部门负责建立古堡档案，及时收集整理古堡保护开发的相关资料。

第十八条 
古堡所在县（市、区）人民政府组织相关部门定期开展安全检查工作。

古堡所有人、管理使用人应当根据国家有关法律法规，健全安全防范管理制度，配备安全防范相关设施，并在相关部门的指导下，制定完善安全防范应急预案。

第十九条  列为全国重点文物保护单位的古堡所有人、管理使用人应当依法建立专职消防队，非全国重点文物保护单位的古堡应当建立志愿消防队，具体承担古堡的火灾扑救工作，提高自防自救能力。

第二十条  在古堡群核心保护区和建设控制地带内，禁止下列行为： 仿宋;mso-bidi-font-family:仿宋\">

（一）在设有禁止烟火标志区域内吸烟、焚香化纸； mso-bidi-font-family:仿宋\">

（二）违反规定倾倒垃圾、排放污水； mso-bidi-font-family:仿宋\">

（三）野炊、燃放孔明灯； mso-bidi-font-family:仿宋\">

（四）涂污、损毁古堡内建筑物、构筑物；

（五）破坏防火、防盗等保护设施；

（六）擅自存储易燃易爆、腐蚀性物品；

（七）擅自进行开山、采矿、采石、采砂、钻探，修建坟墓、垃圾处理场；

（八）擅自迁移、拆除、修缮古堡建筑物及其构筑物；

（九）擅自设置广告牌；

（十）擅自复制、拓印古堡内文物；

（十一）其他有损古堡安全的行为。

 古 -.3pt\">堡的日常保养和维护由所有人、使用人负责。

exactly\">古堡的修缮，应当由取得文物保护工程资质证书的设计、施工、监理单位承担。修缮方案应当严格按照保护规划编制，保持古堡原有形制、结构、材料、工艺及整体建筑色调，并依法报相关部门批准。

mso-bidi-font-weight:bold\">违反本条例规定，涂污、损毁古堡内建筑物、构筑物尚不严重的， mso-bidi-font-family:仿宋;mso-bidi-font-weight:bold\">由县（市、区）公安机关或者文物行政主管部门给予警告，可以并处二百元以下的罚款。

exactly\"> 仿宋;letter-spacing:.2pt\">第二十五条 mso-bidi-font-family:仿宋;letter-spacing:.2pt\"> 违反本条例规定，擅自进行开山、采矿、采石、采砂、钻探的，由县（市、区）国土资源行政主管部门责令停止违法行为、限期恢复原状或者采取其他补救措施；逾期不恢复原状或者不采取其他补救措施的，国土资源行政主管部门可以指定有能力的单位代为恢复原状或者采取其他补救措施，所需费用由违法者承担；造成严重后果的，对单位并处五十万元以上一百万元以下的罚款，对个人并处五万元以上十万元以下的罚款。
